I would tell them in writing you are going to reject the car if you don't have it back in 7 days, give them a shot across the bows, but be prepared to start the rejection process just in case they don't get it back to you in the time frame you specify. 43 days for any sort of repair is a joke.

In pictures, the Mars red always looks very bright or pinkish, but in real life they are darker and more pleasant on the eye

The easiest way to check is the battery gauge in the centre cluster - if the green bar is straight, you have H264 installed, if it's down the bottom of the gauge and curved, you have the old software...
